OAKLAND — A pair of Pleasanton police officers cannot be held criminally liable for fatally shooting a 33-year-old San Jose man more than two years ago, Alameda County District Attorney Pamela Price announced Thursday on her final day in office. The police killing was one of six Price set out to re-examine with her Public Accountability Unit, or PAU. On Feb. 17, 2022, Officers Mario Guillermo and Brian Jewell shot and killed Cody Chavez while responding to a domestic violence call in the 4800 block of Willow Road. Priscilla Presley won a round in court Thursday when a judge ruled that one of two of her former business associates she is suing for elder abuse will remain a defendant in her lawsuit alleging she was bilked out of more than $1 million. Santa Monica Superior Court Judge Mark H. Epstein denied a motion by investor Kevin Fialko to quash the summons served on him. Fialko maintained he is a Tennessee resident, that there is an ongoing case against Presley in Florida and that he has no ties to California, therefore barring a California judge from having personal jurisdiction over him. However, in a lengthy discussion, Epstein said he is satisfied Fialko has enough business ties, as well as potentially residential connections, to California. Man Charged in Deadly Pursuit in Fountain Valley

A 43-year-old man described by prosecutors as a documented white supremacist gang member was charged with murder and other counts Thursday for allegedly setting fire to a Fountain Valley home over a child custody dispute, then leading police on a chase that ended with a crash that killed a woman. Timothy Bradford Cole II of Huntington Beach was charged with single counts of murder and evading a peace officer causing death, along with two counts of evading a peace officer causing serious bodily injury and a count of arson of an inhabited structure, all felonies. He also faces a sentencing enhancement for arson with the use of an acceleration device. Three women sustained injuries, one fatally, around 10 p.m. Monday after Cole allegedly eluded officers, resulting in a collision in Fountain Valley. The victim who died was identified as 25-year-old Hong Ngoc Nguyen, a foreign exchange student from Vietnam. The other two women, both Huntington Beach residents, were released from a hospital Wednesday. “All three victims have been friends since they were in middle school while growing up in Vietnam,” police said in a statement.

Former Baldwin Park, Commerce leaders secretly pleaded guilty in cannabis bribery scheme

The U.S. Attorney’s Office has revealed that Baldwin Park’s former city attorney and Commerce’s former city manager secretly pleaded guilty a year ago to charges related to their participation in a cannabis bribery scheme that has resulted in the arrests of nearly a half-dozen Southern California public officials so far. The two men’s involvement was detailed in prior plea agreements, but the charges against them were not unsealed until Thursday, Dec. 5. Both Baldwin Park’s Robert Tafoya and Commerce’s Edgar Cisneros quietly resigned from their positions in 2022 and 2023, respectively, and have agreed to cooperate in the ongoing investigation. As part of the deal, Tafoya also pleaded guilty to evading payment of approximately $650,000 in federal taxes. The plea deals with Tafoya and Cisneros follow similar arrangements made with former Baldwin Park city councilman Ricardo Pacheco and former San Bernardino County Planning Commissioner Gabriel Chavez. Newsom sticks to his refusal to declare sewage crisis an emergency. ‘It would have meant nothing.’

Gov. Gavin Newsom said Thursday that declaring the Tijuana River cross-border sewage crisis an emergency would “have been just a statement backed up by nothing” to address the longstanding problem. “It would have meant nothing,” he said when asked why he has repeatedly rejected calls from local and state officials. “What some were calling for on this would not have availed us to any real benefit except symbolism and then ultimately frustration that it didn’t mean anything,” he said while at a news conference in Otay Mesa East about a forthcoming border crossing expected to make billions in toll revenue. Newsom’s comments mark what many believe is the first time he has publicly explained his refusal to proclaim an emergency declaration. His administration has made the case that the sewage crisis does not qualify as an emergency under state statute. Woman’s teeth broken with gun amid violent robbery in Southern California

A serial robbery suspect from South Los Angeles, who reportedly smashed a victim’s teeth with his gun, is facing the possibility of life in federal prison after a nearly month-long crime spree, officials with the U.S. Department of Justice announced Thursday.   In a news release, DOJ prosecutors say 21-year-old Oshae Pollard, a resident of L.A.’s Manchester Square neighborhood, targeted victims in parking lots, committing at least three armed robberies and one attempted robbery between Aug. 25 and Sep. 22.   In a brutal Aug. 25 robbery outside the Hustler Casino in Gardena, the 21-year-old allegedly shoved a woman to the ground and attempted to steal her purse as she screamed for help.   Prosecutors said Pollard pulled a semiautomatic pistol on the victim and shoved it into her mouth, breaking her teeth in the process and saying, “If you yell again, I’ll kill you.”   When a witness to the robbery began to yell, Pollard grabbed the victim’s purse and fled in a vehicle, getting away with $1,000 – $2,000, the release detailed.   In the early morning hours of Aug. 26, the 21-year-old

LA County probation chief submits resignation days before juvenile hall’s potential shutdown

On the eve of a showdown over the potential closure of trouble-plagued Los Padrinos Juvenile Hall, Los Angeles County’s chief probation officer has told county leaders he plans to retire by Dec. 31, but sources familiar with the matter say his exit has not been finalized. Probation Chief Guillermo Viera Rosa is scheduled to meet with the Board of Supervisors at its Tuesday, Dec. 10, meeting to determine whether he will remain with the county. The board’s agenda lists two closed-door matters related to Viera Rosa: a performance evaluation and an item considering his possible replacement. Both the Probation Department and the county’s Chief Executive Office declined to comment on Viera Rosa’s resignation letter. Traffic stop near Cottonwood leads to arrest of Venezuelan man

COTTONWOOD – The Shasta County Sheriff’s Office announced a traffic stop on the highway led to an arrest and alleged discovery of cocaine and firearms. The California Highway Patrol around 8 a.m. Tuesday stopped a vehicle traveling northbound on Interstate 5 for a traffic violation. SCSHO said during the traffic enforcement stop, the vehicle’s driver was identified as Danny Zambrano, 25, of Venezuela. He was the only person in the vehicle. The CHP officer utilized his narcotic-odor detection K9, which resulted in a probable cause search of the vehicle.  Law enforcement claims during the search, around 51.5 grams of suspected cocaine, an AR15-style pistol, a Glock handgun, high-capacity magazines, and ammunition were found inside the vehicle. After discovering the contraband, the Shasta Interagency Narcotics Task Force was contacted and responded to assume the investigation. Law enforcement claims  SINTF detectives placed Zambrano under arrest on suspicion of possession and transportation of a controlled substance for sale, possession of a non-serialized assault weapon, possession of a loaded firearm while possessing a controlled substance and possession of high-capacity magazines.
