McDonald’s Customer Settles With Franchise Owner Over Hot Coffee Spill
A woman has tentatively settled her personal injury suit against a McDonald’s franchise owner after she allegedly suffered injuries while being handed a cup of hot coffee with an unfastened lid in the drive-through lane of a restaurant south of downtown in 2022. An attorney for Erika Nicole Turner filed court papers Thursday with Los Angeles Superior Court Judge Kerry Bensinger notifying him of a “conditional” resolution of her case against Sanchez Family Corp. IV with the expectation a request for dismissal will be filed by Dec. 30. No terms were revealed. In her case, brought Feb. 29, Turner says she bought the coffee at the McDonald’s restaurant in the 200 block of West Washington Boulevard on March 4, 2022. The cup’s lid was not sufficiently secured on the cup when an employee handed it to her, the suit alleges. The complaint further alleges that management had the obligation to operate the restaurant in a manner safe to customers and that their alleged failure to do so in Turner’s case has left her with both economic damages as well as pain and suffering.
